Are part-time positions acceptable for the 482 TSS visa?

When it comes to the TSS 482 visa, the Department of Home Affairs typically requires that the position be full-time. However, there are exceptions that can allow for part-time positions to meet the full-time requirement under certain circumstances. This flexibility aims to accommodate highly skilled overseas workers in specialised fields, benefitting Australia.

Part-time work arrangements can gain approval as long as they align with the Australian workplace relations framework.

These situations may include:

a) Fractional appointments for overseas academics in Australian universities, where senior academics or leading international academic experts hold primary positions overseas but take on fractional appointments in Australia for specific projects or time periods.

b) Registered Nurses and highly specialised medical practitioners, such as locum doctors or medical practitioners working independently, especially in rural and regional areas, who prefer part-time or irregular hours.

c) Non-executive directors and senior specialised managers, like highly paid board members of Australian-listed companies attending occasional board meetings in Australia, often working only a few times a year.

d) Existing TSS visa holders who temporarily reduce their hours to return to work part-time after parental leave or other situations consistent with their visa conditions.

What is the TSS Visa?

The TSS 482 visa aims to assist employers in addressing labour shortages by bringing in skilled workers when suitable Australian candidates are unavailable. It focuses on the targeted use of overseas workers to fill temporary skill gaps while prioritising Australian workers.

This visa program offers three streams:

  • Short-term stream: For sourcing temporary overseas skilled workers to fill short-term roles for up to two years (or four years with international trade obligations).
  • Medium-term stream: To hire highly skilled overseas workers for critical skills for up to four years, with an option for permanent residence after three years.
  • Labour Agreement stream: Used when an employer has a labour agreement with the Commonwealth to address skill shortages not met in the Australian market through the standard TSS visa program.

TSS visa holders can work for their approved sponsor in their designated occupation, bring eligible dependents to Australia, and have no travel restrictions while the visa is valid. Strong worker protection measures are in place to ensure equal workplace rights for overseas skilled workers and Australian citizens or permanent residents.

In the context of part-time work, it's important to note that TSS visa holders are typically expected to be employed in full-time positions, in line with the visa requirements. While part-time work arrangements may not be considered a breach of visa conditions, sponsors must ensure they can meet their obligations when employing primary visa holders part-time.
